At Kress Law, our team is experienced in all aspects of real estate in Alberta. Whether you’re a first time home buyer or a seasoned real estate investor, we’ll make every step of the legal process clear and easy to understand.
We handle residential conveyancing, including purchases, mortgages, sales and refinancing. On private transactions, we can assist with the preparation of purchase agreements. We can also facilitate more complex residential transactions, including rent-to-own contracts and vendor take-back financing arrangements, as well as house swaps. We can also assist with residential leases and residential tenancy matters. When appropriate, and with client consent, we often act for both the vendor and purchaser, and offer a discount to our fees in those cases.
Building a house? No problem. We can assist with your construction mortgage and related issues, as well.
We offer competitive residential real estate fees, however, due to the number of disbursements on residential real estate files, we ask that you contact our conveyancing department for a fee quote. It is important to us that your quote include all of the anticipated disbursements, such as title insurance, that you are likely to incur. Our real estate fees are all-inclusive, meaning that we do not upcharge clients for issues such as compliance or real property report (RPR) issues, GST issues or other complications that frequently arise in real estate transactions. That means that, while we do not offer the lowest flat-fee real estate fees in the province (our goal is not to be the cheapest law firm), our clients can have real certainty as to what their transaction will cost, and not just certainty of what it will cost if everything goes perfectly.
We also handle all aspects of commercial real estate law, including assistance with due diligence, drafting purchase contracts, purchases, mortgages, sales and commercial financing and security transactions. We assist frequently with commercial leases, both for landlords and tenants, and can draft and review commercial leases.
Commercial financing arrangements have grown drastically more complex as lenders have increased their requirements. Our experience and organizational prowess will ensure that your financing is completed as quickly as possible for you to get access to the funds needed to operate and grow your business.
Our firm can assist you if you are looking to buy or sell farmland, or to borrow against it. We are knowledgeable about the issues that arise on agricultural transactions, such as surface lease issues, water rights, and related tax and GST matters. We have assisted clients successfully in selling farmland by tender, resulting in timely sales at or above appraised value.
